Sentlowitz v. Cardinal Development

In Sentlowitz v. Cardinal Development, LLC, 63 A.D.3d 1137 (2nd Dept. 2009), an action that involved the sale of real property to the plaintiffs by the defendant Cardinal Development, LLC. There, the plaintiffs, asserting causes of action to recover damages for, inter alia, fraudulent concealment, alleged that the appellants concealed the fact that the subject property contained land designated as wetlands by the United States Army Corps of Engineers. The Appellate Division, Second Department held that the Supreme Court properly determined that the amended complaint stated a cognizable cause of action to recover damages for fraudulent concealment against the defendants.
