In Smith v. Manhattan & Bronx Surface Tr. Operating Auth., (58 A.D.3d 552 [1st Dept. 2009]) the First Department affirmed an award of $800,000 of future pain and suffering to a plaintiff who suffered "severe damage to her left knee, including tears of the medial and lateral menisci, a torn ligament, torn cartilage in various places, and damage to the patella, with permanent osteochondral defect" The plaintiff had chronic pain and would perhaps require a total knee replacement.
