Sorel v. Iacobucci

In Sorel v. Iacobucci, 221 A.D.2d 852 (3rd Dep't 1995) the Appellate Division, Third Department, observed that "this court has indicated that some degree of viciousness could be implied in the case of a German Shepherd ," and limited those prior holdings only by determining that "there is no authority for the proposition that judicial notice must in fact be taken."
