TSR Consulting Servs. v. Steinhouse

In TSR Consulting Servs. v. Steinhouse, 267 A.D.2d 25 [1st Dept 1999] the court denied summary judgment and found that the contract of employment stating that the defendant "will receive a guaranteed recoverable draw of $ 10,000 for the first year of employment" and "for the second year of your employment you will receive a guaranteed recoverable draw of $ 120,000 against commissions," was consistent with a hiring for a definite two year period, although not so clear as to render that interpretation the only one. The contract also spoke of the "first twelve months" of employment, which extended "through May 31, 1998."
