Tenzer Greenblatt, LLP v. Rinfret

In Tenzer Greenblatt, LLP v. Rinfret, 9/16/97, NYLJ, 27, col 5, Angelo Cometa was a member of the law firm of Phillips Nizer Benjamin, Krim & Ballon at the time the original retainer agreement prepared on the firm's letterhead was signed by him and the client. Thereafter, Mr. Cometa left the firm and joined the law firm of Tenzer Greenblatt, L.L.P., where he rendered services to the client. All bills were prepared on Tenzer Greenblatt's letterhead. The law firm commenced a plenary action to recover its fee. The court found that the plaintiff law firm adopted the original retainer agreement and that the requirements of 1400.3 were satisfied. The court denied the defendant client's motion to dismiss and sustained Tenzer Greenblatt's fee request.
