Thibault v. Franzese

In Thibault v. Franzese (24 A.D.2d 903 [2d Dept 1965]), the Second Department held that the "defendants' duty to use reasonable care to protect the plaintiff . . . a 73-year old senile woman, whom . . . the defendants had undertaken to care for while she was in their home, was not measured by what their duty would have been to a social guest as a mere licensee . . . They were required to use reasonable care to protect her from injury".
