Tilson v. Russo

In Tilson v. Russo, 30 AD3d 856 (3d Dept 2006) the court held that even if the owner failed to comply with industry standards, any conditions created by owner's alleged negligence were neither unique nor created a dangerous condition over and above usual dangers that were inherent in sport of horseback riding, including the sudden and unintended action that the horse would bite the rider.
