Travelers Indemnity Co. v. Zeff Designs

In Travelers Indemnity Co. v. Zeff Designs (60 AD3d 453, 875 N.Y.S.2d 456 [1st Dept 2009]), the Court found that there was no evidence of negligence on the party of the party who filed the TR-1 "only to expedite the filing process for obtaining a construction permit." A party who files forms with DOB stating that it assumes responsibility for controlled inspections can be held liable, where such failure proximately causes injury.
