Whitestone Savings and Loan Assn. v. Allstate Ins. Co

In Whitestone Savings and Loan Assn. v. Allstate Ins. Co., 28 N.Y.2d 332 [1971] a mortgagee bid the full amount of a secured debt at a foreclosure sale, obtained the property, and then sought to retain the right to recover the partial loss of the property under a fire insurance policy. The court held that once the mortgagee bid the full amount of the money owed, received the deed and title to the property, the debt was satisfied, and its insurable interest was terminated. The owner-mortgagor and/or subsequent lienors, if any, were entitled to recover the loss.
