Young v. Tops Mkts

In Young v. Tops Mkts. (283 A.D.2d 923, 725 N.Y.S.2d 489 [2001]), the Court stated that the trial court did not abuse its discretion by applying a discount rate in effect at the time of the verdict. The judgment was entered one year and four months after the jury verdict on damages. The court reads CPLR 5041 and the above case law to give it discretion in the selection of the "time of the award."
