Shoaf v. Kimberly-Clark Corp

In Shoaf v. Kimberly-Clark Corp., 294 F. Supp. 2d 746 (M.D.N.C. 2003), the plaintiff filed an employment discrimination claim under Title VII of the Civil Rights Act of 1964, 42 U.S.C. 2000e et seq. Id. at 749. The plaintiff admitted to disclosing information in violation of his confidentiality agreement with the defendant. Id. at 752. The Shoaf Court then granted summary judgment because the evidence presented showed that defendant "focused only upon Plaintiffs breach of his duties of confidentiality and loyalty owed to Defendant as a basis for their decision to discharge Plaintiff."
