State v. Hemby

In State v. Hemby, 333 N.C. 331, 336, 426 S.E.2d 77, 79-80 (1993), there were eight indictments, each carrying a presumptive term of one year. The consolidated sentences totaled eight years. Upon resentencing after six of the indictments were remanded, the new sentence remained eight years. Our Supreme Court held that this amounted to a sentence greater than that originally imposed -- one year for each offense.
