Vernon v. Steven L. Mabe Builders

In Vernon v. Steven L. Mabe Builders, 336 N.C. 425, 444 S.E.2d 191 (1994), the Supreme Court held that the Industrial Commission failed to conduct a full investigation to determine the fairness of a Form 26 compensation agreement. The plaintiff sustained a compensable back injury and received temporary total disability benefits. Upon reaching maximum medical improvement, the plaintiff's physician rated the plaintiff as having a 15 percent permanent disability to his back, but stated that he did not think the plaintiff could return to work.
