Barnes v. Univ. Hospitals of Cleveland

In Barnes v. Univ. Hospitals of Cleveland, Cuyahoga App. Nos. 87247, 87285, 87710, 87903, 87946, 2006 Ohio 6266, the plaintiff argued that the amended version of R.C. 1343.03(C) was inapplicable because her complaint was filed before the effective date of the amendments. The Eighth District disagreed, reasoning: "Although this statute was enacted after the suit was originally filed, it was in place before the prejudgment interest determination hearing was conducted, thus, it is applicable. The trial court's actions did not constitute a retroactive application because the current version of the statute was firmly in place before prejudgment interest was evaluated."
