Bryant v. Williams

In Bryant v. Williams (June 7, 1985), Montgomery App. No. CA 9272, an attorney improperly released funds he held for a client in an escrow account. The plaintiff claimed fraud. The court granted summary judgment on a finding that the claim was for legal malpractice and barred by the one-year statute of limitations. The Court held that the claim in the action filed against the attorney was both in malpractice and for breach of contract to perform services not necessarily legal in nature, by acting as an escrow despository. The Court reversed and remanded for further proceedings on the non-malpractice claim.
