Cincinnati v. Public Utilities Com

In Cincinnati v. Public Utilities Com. (1992), 63 Ohio St.3d 366, 588 N.E.2d 775, the Ohio Supreme Court held that a "refusal to dismiss a proceeding on jurisdictional grounds did not affect a substantial right of the appellant because the city could appeal such issue to the court after the commission had issued its final order on the merits. The court reasoned that an appeal only on the jurisdictional issue would result in a "split appeal," which would serve only to prolong and confuse litigation."
