Continental Ins. Co. v. Whittington

In Continental Ins. Co. v. Whittington (1994), 71 Ohio St.3d 150, 1994 Ohio 362, 642 N.E.2d 615, the evidence adduced at trial revealed the existence of genuine issues of material fact concerning issues raised by Continental in its motion for summary judgment. Though the record reflected this was not the circumstance at the time the court denied Continental's motion for summary judgment because the facts adduced at trial demonstrated Continental's liability, the Supreme Court of Ohio found the error in the trial court's denial of summary judgment was either moot or harmless.
