In Felger v. Tubetech, Columbiana App. No. 2000 CO 23, 2002 Ohio 1161, the Seventh District found collateral estoppel did not prevent an employee from raising a claim of discharge without just cause in an arbitration proceeding and later filing suit for racial discrimination, because two remedies have legally independent origins and must be equally available to the employee, Felger at P49, citations deleted. "Logic dictates when an employee complains of being wrongfully discharged, the reason for discharge will be at issue. This will always be the case." Id.
