In Gearhart v. Gearhart (Nov. 19, 1999), Montgomery App. No. 17725, 1999 Ohio App, the Court held that the trial court was in the best position to determine whether a final divorce decree and QDRO's needed clarification in order to equitably divide a party's retirement benefits. There, the final divorce decree and amended QDRO did not address the manner in which the husband's retirement would be divided if he elected early retirement. Instead, these orders spoke in broad terms of "accrued benefits." Id.
