In Re Kobak

In Re Kobak (Bkrtry. N.D. Ohio, 06-28-2002) 280 B.R. 164, involved lien subordination between first and third mortgages, whereby first mortgagee relinquished priority that it would otherwise have over third mortgagee. The subordination agreement did not affect the second mortgagee either positively or negatively. It simply required that if the property were sold, those proceeds otherwise due the first mortgagee would be paid initially to the third mortgagee to the extent of its claim.
