Keiber v. Spicer Constr. Co

In Keiber v. Spicer Constr. Co. (May 28, 1999), Greene App. No. 98CA23, 1999 Ohio App, the Second Appellate District concluded that a CSPA claim was not time-barred because the evidence demonstrated that the defendant, who entered into a contract with the plaintiff for the purchase of property and construction of a new home, continued to represent that it would fix items that needed repair after the real estate transfer closed and within two years prior to the plaintiff filing a complaint. The court stated that, "these continued representations that Spicer Construction would fix the items that needed repair constitute 'an unfair or deceptive act or practice' after the transaction."
