Maloney v. Maloney

In Maloney v. Maloney, 160 Ohio App.3d 209, 222, P48, 2005 Ohio 1368, 826 N.E.2d 864, the Second District Court of Appeals held that joint debts are not property or interests in property that the trial court must equally divide between the parties. The trial court may allocate debt on an unequal basis and order one or the other of the parties to pay some or all of the joint debt out of his or her share of marital or separate property. But so long as the allocation is equal there is no abuse of discretion.
