Shadoan v. Summit Cty. Children Serv. Bd

In Shadoan v. Summit Cty. Children Serv. Bd., 9th Dist. No. 21486, 2003 Ohio 5775, the Court elaborated on the type of conduct that meets the standard set forth in R.C. 2744.03(A)(6). Regarding malice, we stated that "in order for a malicious purpose to exist, there must be ill will or enmity of some sort." Shadoan, supra, at P12. Malice includes "the willful and intentional design to do injury, or the intention or desire to harm another through conduct which is unlawful or unjustified." Id.
