State v. Boston

In State v. Boston (1989), 46 Ohio St.3d 108, 545 N.E.2d 1220, modified on other grounds by State v. Dever (1992), 64 Ohio St.3d 401, 1992 Ohio 41, 596 N.E.2d 436, the Supreme Court of Ohio held that in cases involving alleged child abuse, "the use of expert testimony is perfectly proper and such experts are not limited just to persons with scientific or technical knowledge but also include other persons with 'specialized knowledge' gained through experience, training or education." Id. at 126. The expert witness, however, "may not testify as to the expert's opinion of the veracity of the statements of a child declarant." Id. at syllabus.
