State v. Garrett

In State v. Garrett, 4th Dist. No. 05CA802, 2005 Ohio 5155., the appellate court affirmed the trial court's ruling on the defendant's motion to suppress finding the stop improper because the officer did not possess a reasonable articulable suspicion that a traffic violation occurred. Garrett at PP13-14. Garrett stopped his vehicle and skidded in the gravel on the road; other than that, the arresting officer did not observe any traffic violations or erratic driving. Garrett at PP3-4.
