State v. Gipson

In State v. Gipson, 80 Ohio St.3d 626, 1998 Ohio 659, 687 N.E.2d 750, the Ohio Supreme Court held that the requirement that an affidavit must be "filed" with the court prior to sentencing means that "the affidavit must be delivered to the clerk of court for purposes of filing and must be indorsed by the clerk of court, i.e., time-stamped, prior to the filing of the journal entry reflecting the trial court's sentencing decision."
