State v. Lowe

In State v. Lowe (1994), 69 Ohio St.3d 527, 529, 1994 Ohio 345, 634 N.E.2d 616, the Supreme Court held that to be admissible, the acts must establish the identity of the perpetrator by showing that he has committed similar crimes and that a distinct, identifiable scheme, plan or system was used in the commission of the charged offense. Id. The Court then concluded that other acts evidence of displaying pornography to young girls did not tend to prove identity in a trial for a non-sexually motivated murder. Id.
