Wayco v. Wayco

In Wayco v. Wayco (March 8, 1999), Stark App. No. 1998-CA-00279, 1999 Ohio App, the Court cited Booth v. Booth (1989), 44 Ohio St. 3d 142, 541 N.E.2d 1028, as authority for the proposition an appellate court applies the abuse of discretion standard in reviewing matters concerning child support. Abuse of discretion implies the court's attitude is unreasonable, arbitrary, or unconscionable, Id. In Wayco, the Court found absent special circumstances, a trial court should make the modified child support retroactive to the date the parties received notice of the request for modification, because this makes decisions regarding the effective date of child support modification consistent, predictable, and fair, Id.
