Wells v. Spirit Fabricating, Ltd

In Wells v. Spirit Fabricating, Ltd. (1996), 113 Ohio App.3d 282, 680 N.E.2d 1046, the appellate court concluded that the plaintiff's settlement with and release of the employee/defendant also released the employer. An 'employer cannot be found to be liable for negligence he did not commit. The employer's liability is dependent on the negligence of the employee. Since the plaintiff released the employee for his negligence, there is no basis to support plaintiff's claim against Spirit the employer.' Id. at 294, 680 N.E.2d 1046.
