Commonwealth v. Benner

In Commonwealth v. Benner, 2004 PA Super 243, 853 A.2d 1068 (Pa. Super. 2004), the Court rejected Benner's claims that because he had negotiated his plea on the understanding that he would not be subject to registration and the sentencing court did not inform him of the registration requirement, his plea was rendered involuntary. The Court rejected the claims, reasoning that "because the registration requirement under either Megan's Law I or II is a collateral consequence of the defendant's plea, the failure of the court to apprise him of it does not invalidate the plea." Id. at 1071.
