East Caln Township v. Borough of Downingtown

In East Caln Township v. Borough of Downingtown, 40 Pa. D. & C. 2d 405, 58 Mun. L Rep. 32, 14 Chest. Co. 161 (1966), the township filed a petition seeking approval from the trial court to connect its proposed sewage lines to a borough's existing sewage system. In discussing that case, the trial court stated that the township "having reached no agreement with the adjacent borough for connecting its proposed sewer lines with Downingtown's borough's existing sewer system, township filed its petition ... setting forth the facts and asking the court to determine that such connection can be made 'without impairing the usefulness of the existing sewer' ...." Id. at 406.
