Messina v. East Penn Township

In Messina v. East Penn Township, 995 A.2d 517 (Pa. Cmwlth. 2010), the Court held that although the procedural requirements of the MPC were violated in the adoption of an ordinance, procedural due process rights of owners were not violated where they had notice of and participated in meetings held regarding the ordinance's adoption. Specifically, the Court held that "given the passage of time after the original adoption of the zoning ordinance and the absence of proof of discernible harm, no denial of due process is evident." Messina, 995 A.2d at 536.
