Moore v. Reed

In Moore v. Reed, 126 Pa. Commw. 283, 559 A.2d 602 (Pa. Cmwlth. 1989), the Court found a municipal contract unenforceable when it was entered into by the Mayor alone, with no action by the City Council. The Court concluded that although the Mayor exercises the city's executive power, its legislative power rests in the city council that retains "the authority to negotiate a valid and binding contract for a municipality ...." Id. at 603.
