Pakett v. The Phillies L.P

In Pakett v. The Phillies L.P., 871 A.2d 304 (Pa. Cmwlth. 2005), the plaintiff attended a major league baseball game and was struck by a foul ball while sitting in the stands. The plaintiff had sat in the seat before and knew that foul balls reached that area. The Court affirmed the grant of summary judgment determining that the risk of being hit by a foul ball during a baseball game was an inherent risk of attending a game. Additionally, the team did not assume additional duties by placing a protective screen behind home plate.
