Stewart v. Zoning Hearing Board of Radnor Township

In Stewart v. Zoning Hearing Board of Radnor Township, 110 Pa. Commw. 111, 531 A.2d 1180, 1182-1183 (Pa. Cmwlth. 1987), the Court held that a zoning hearing board lacked jurisdiction to determine the specifics of a sewage disposal system for a proposed residential subdivision. The zoning board's authority was limited to making sure that the system proposed was "an accepted method for waste management by DEP." Id.
