Trinisewski v. Hudock

In Trinisewski v. Hudock, 90 Pa. Commw. 159, 494 A.2d 504 (Pa. Cmwlth. 1985), county commissioners enacted a 1982 ordinance increasing the salaries of all county officials. The ordinance was to take effect immediately, but, by its terms, was applicable to each official when permitted by the State Constitution. At the time of passage, each of the plaintiffs was in his second year in office, and, therefore, the higher salaries were paid only after the plaintiffs assumed their new terms. Shortly thereafter, a new majority of commissioners enacted a 1984 ordinance repealing the prior ordinance, reducing salaries and refusing to pay the salaries provided for in the 1982 ordinance. The court held that the 1984 ordinance could not be applied retroactively to the plaintiffs.
