Underground Storage Tank Indemnification Fund

In M. H. Davis Estate Oil Company, Inc. v. Underground Storage Tank Indemnification Board, 789 A.2d 398, 403 (Pa. Cmwlth. 2001), petition for allowance of appeal denied, 569 Pa. 686, 800 A.2d 935 (2002), the Court stated that the Underground Storage Tank Indemnification Fund (Fund) is a statutory creature in which the General Assembly requires mandatory participation by those who will benefit by it. The Fund provides coverage to storage tank owners to clean up storage tank releases that pose a significant health risk to the general public. M.H. Davis, 798 A.2d at 403.
