Auth. v. Trevino

In Auth. v. Trevino, 941 S.W.2d 76, 81-82, 40 Tex. Sup. Ct. J. 313 (Tex. 1997), the court held that a plaintiff's settlement with a defendant does not affect the degree of waiver of sovereign immunity that the legislature has prescribed. Trevino, 941 S.W.2d at 81-82. Although the dollar amount of a settlement must be reduced from the verdict under the "one satisfaction" rule, the settlement does not affect the maximum dollar amount to which the government has agreed to waive its immunity. Id at 82.
