Barshop v. Medina County Underground Water Conservation District

In Barshop v. Medina County Underground Water Conservation District, 925 S.W.2d 618 (Tex. 1996), the Court concluded that the plaintiffs were entitled to judicial review because the Edwards Aquifer Act provided that the Edwards Aquifer Authority "is subject . . . to the APA." Id. at 633. The Court concluded that, because this language had no meaning other than to require the Authority to abide by the APA, the APA's provisions regarding contested case hearings and judicial review applied. See Barshop, 925 S.W.2d at 632-33. Continental contends that section 401.021 similarly provides that commission hearings are "governed by" the APA, meaning that the APA provisions on judicial review apply.
