Case Dealing With Indictment for Stabbing In Texas

In Mata v. State, 939 S.W.2d 719, 727 (Tex. App.--Waco 1997, no pet.) the indictment stated he killed the victim by "stabbing" him; it did not name any object used to stab the victim. The court disagreed with the State's argument that Mata was put on notice because he "would necessarily have used some object to stab" the victim. Id. Thus, the Mata court did not require an explanation of how the object was used to stab the victim, it required the identification of the object used.
