In City of Austin v. McCall, 95 Tex. 565, 68 S.W. 791, 793 (Tex. 1902), a taxpayer obtained an injunction prohibiting the City of Austin from consummating a proposed contract to purchase a water and power utility. In affirming the injunction, we said that "'it would seem eminently proper for courts of equity to interfere upon the application of the taxpayers of a county to prevent the consummation of a wrong, when the officers of those corporations assume, in excess of their powers, to create burdens upon property holders.'" McCall, 68 S.W. at 794.
