In City of Laredo v. R. Vela Exxon, Inc., 966 S.W.2d 673, 678 (Tex. App.--San Antonio 1998, pet. Denied) the City argued trial court error in rendering judgment against the City based on a taking of property because the trial court's findings conclusively established no such taking occurred as a matter of law. The court stated that findings filed after a judgment are controlling if there is any conflict between them. Id. (citing Arena, 822 S.W.2d at 652). The court also stated that when an appellate court is presented with a conflict between a judgment and subsequent findings, the appellate court has the power to modify the judgment to conform with the findings. Id. In City of Laredo, the court reviewed the trial court's findings under a legal sufficiency standard of review and modified the judgment of the trial court to conform with the trial court's findings. 966 S.W.2d at 678-81.
