Daughety v. National Association of Homebuilders of the United States

In Daughety v. National Association of Homebuilders of the United States, 970 S.W.2d 178 (Tex. App.-Dallas 1998, no pet.), the court of appeals affirmed an order denying class certification. Id. at 182. Although the plaintiffs had sought to certify a nationwide class on several causes of action, they argued on appeal that the trial court should have certified a class on a single claim. Id. The court of appeals affirmed the trial court's order because the plaintiffs had never presented the trial court with an opportunity to rule on a single-claim class. Id.
