In Clayton W. Williams, Jr., Inc. v. Olivo, 952 S.W.2d 523 (Tex. 1997), the Texas Supreme Court held where one employed by an independent contractor is seeking to hold a general contractor liable for defects that exist on the premises when he entered on the premises for business purposes or that are created through some means unrelated to the activity of the injured employee or his employer, a jury charge that does not include the premise defect elements set forth in Corbin v. Safeway Stores, Inc., 648 S.W.2d 292, 296 (Tex. 1983), cannot support a recovery in a premises defect case. Olivo, 952 S.W.2d at 529.
