Hoffman v. Davis

In Hoffman v. Davis, 128 Tex. 503, 100 S.W.2d 94, 95 (Tex. 1937), taxpayers sued the sureties on county officials' bonds for payment on the bonds due to the officials' misconduct. Although we reaffirmed "the right of a taxpaying citizen to go into a court of equity and enjoin public officials from the expenditure of public funds under an illegal contract", the Court concluded that the action did not fit within this rule but was rather a suit for debt which properly belonged to the county.
