Hooper v. Torres

In Hooper v. Torres, 790 S.W.2d 757, 759-760 (Tex.App.--El Paso 1990, writ denied) the Court considered whether the trial court erred in excluding a major portion of a doctor's report. Id. at 759. It examined whether the report was a business record and thus an exception to the hearsay rule. Id. at 760. An employee of El Paso Orthopedic Surgery Group had testified that the letter in question contained the signature of the doctor, that he was licensed to practice medicine in Texas and was board certified as an orthopedic specialist, that the letter was the type of record made in the ordinary course of business, and that someone with knowledge of the events recorded made a record at or about the time the events occurred. Id.
