Ia a Car Parked Off the Road Considered ''Public Place''

In Longoria v. State, 624 S.W.2d 582 (Tex. Crim. App. [Panel Op.] 1981), a police officer on routine patrol observed a car parked ten to twenty feet off the main road through a public park in Houston. The officer could see two heads in the front seat of the car. He approached the car and found the appellant and another man asleep and nude from the waist down. The court held that the car, parked ten to twenty feet off the main park road with its interior in open view, was readily accessible to the public and therefore was a public place. Id. at 584.
