Kuzniar v. State Farm Lloyds

In Kuzniar v. State Farm Lloyds, 52 S.W.3d 759, 761 (Tex. App.-San Antonio 2001, pet. denied), the insureds filed a claim with State Farm in 1992 regarding a plumbing leak. Id. at 760. State Farm opened a claim file and sent an adjuster to investigate the claim, and the adjuster asked the insureds to hire a plumber to investigate the leak. Id. Neither State Farm nor the adjuster heard back from the insureds, and in January 1993 State Farm closed the claim file. Id. in August 1996, the insureds sued State Farm. Id. The court of appeals affirmed the trial court's summary judgment on the statute of limitations issue, concluding that "the closing of the claim file was an objectively verifiable event that unambiguously demonstrated State Farm's intent not to pay the claim.. . ." Id.
