Prudential Ins. Co. v. Tate

In Prudential Ins. Co. v. Tate, 162 Tex. 369, 347 S.W.2d 556, 4 Tex. Sup. Ct. J. 513 (Tex. 1961), the Court considered a total disability provision. The Tate provision provided total disability benefits if the insured was "wholly, continuously and permanently unable to engage in any occupation or perform any work for any kind of compensation of financial value during the remainder of his lifetime." Tate, 347 S.W.2d at 558-59.
