Quest Chemical Corp. v. Elam

In Quest Chemical Corp. v. Elam, 898 S.W.2d 819, 820, 38 Tex. Sup. Ct. J. 681 (Tex. 1995) the Court considered FIFRA's preemptive effect in the context of a personal injury suit. The Court reversed the court of appeals' judgment that allowed the plaintiff's strict liability and implied warranty claims to escape federal preemption. The Court stated, "FIFRA preempts all common law tort suits against manufacturers of EPA-registered pesticides which are based solely upon claims relating directly or indirectly to labeling." Id.
